It is possible that it could be considered an analog (of psilocin and psilocybin), in which case, sales for human consumption or possession with the intent to ingest could be prosecuted under the Federal Analogue Act though we are unaware of any such existing cases (8/12/2011).

4-HO-MET was added to Schedule I (slightly different than US Schedule I), making it illegal to possess without a license as of May 2012. Medical Products Agency lists it in their regulation LVFS 2012:6 listed as 4-HO-MET
